Leaving aside the issue of whether Tosh is dirty (or dirtier than the norm in the NCAA), the bigger issue for me is that he really did Cal dirty when he left. We can all debate whether Tedford or Sandy didn't step up enough for Tosh, and any assistant is entitled to leave for greener pastures given the low pay and job insecurity. But let's not forget that he left not only in the final weeks of the recruiting cycle, but was doing in home visits when he basically had taken the UW job. So much so, that Cal didn't even view those in homes (wasn't Shaq one of them?) as Cal in homes.
Again, we can say that some of that is on Tedford and Cal, but to my mind Tosh crossed the line by leaving in mid-January and re-recruiting the same kids. Had he been fired or left in December, he could re-recruit all day long and I wouldn't begrudge him. But he left for a better gig (in his mind) and did it in mid-January. That's on him in my view and he needed to observe some basic decency.
And on top of that, recall the rumors that he not only re-recruited those kids, but used Cal's academics and the struggles of his other recruits at Cal to recruit negatively against us when he got to UW. You can say generally that Cal is a tough school academically etc., but if that happened -- and he specifically talked about Vimi or other players struggling -- that also crossed the line.
So under those circumstances (even if the Tosh stink factor wasn't an issue), I wouldn't bring him back. He crossed the line and we should have some self-respect.
As an aside, my SC friends speculate that Helton is going to blow out the whole defensive staff, so Wilcox and his crew will be on the street. Don't know if/how that plays into Tosh's future, but Wilcox was his boy.
